Peptide Product Waiver and Release of Liability
The peptide products sold by TAUSEL CONSULTING LLC d/b/a Peak Pursuit Wellness (“Company”) are intended for research and laboratory purposes only. These products are not intended for human consumption, medical use, diagnostic use, or therapeutic application of any kind. By purchasing, possessing, handling, or using these products, you (“Purchaser”) acknowledge and agree to the following terms.
TAUSEL CONSULTING LLC d/b/a Peak Pursuit Wellness makes no representations or warranties regarding the safety, efficacy, suitability, or results of these products. You understand and accept that the use, handling, storage, or misuse of peptide products may carry inherent risks, including but not limited to health hazards, injury, adverse reactions, or other serious consequences. You voluntarily assume full responsibility for all risks associated with the purchase, possession, handling, storage, use, or misuse of these products.
You further acknowledge that any information provided by TAUSEL CONSULTING LLC d/b/a Peak Pursuit Wellness, whether written, verbal, digital, or otherwise, is strictly for educational and informational purposes only. Nothing provided by the Company constitutes medical advice, diagnosis, treatment, or a recommendation for use, and such information should not be relied upon as a substitute for consultation with a licensed healthcare provider.
To the fullest extent permitted by law, you hereby release, waive, and forever discharge TAUSEL CONSULTING LLC d/b/a Peak Pursuit Wellness, along with its owners, officers, members, employees, contractors, agents, affiliates, successors, and assigns (collectively, the “Released Parties”), from any and all claims, liabilities, damages, losses, injuries, demands, causes of action, costs, or expenses, whether known or unknown, that may arise out of or relate in any way to the purchase, possession, handling, storage, use, or misuse of peptide products.
You also agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, expenses, attorney’s fees, liabilities, or losses resulting from or related to your purchase, possession, handling, storage, use, or misuse of peptide products.
Acknowledgment, Consent, and Electronic Signature
Please read this Waiver and Release of Liability carefully before submitting. By checking the acknowledgment box below, typing your full legal name, entering the date, and clicking submit, you acknowledge that you have carefully read, fully understood, and voluntarily agreed to this Waiver and Release of Liability. You further agree that your checkbox selection, typed name, entered date, and submission shall serve as your electronic signature and consent to be bound by the terms of this agreement.
Client Acknowledgment & Informed-Consent Disclosure
Nature of compounded peptides
I understand that compounded peptide products are not FDA-approved for safety, effectiveness, or quality. Their manufacturing, identity, purity, sterility, and potency depend on the compounding pharmacy and may vary.
FDA Category 2 and under-review substances
I understand that certain peptides have been identified by FDA as Category 2 substances presenting significant safety risks, and that other peptides are currently under review by FDA's Pharmacy Compounding Advisory Committee. If a substance on either list is part of my proposed protocol, I understand that legal availability and clinical appropriateness must be determined by my licensed clinician and that this status may change. If my proposed protocol includes a blend or stack of multiple peptides, I understand that the most restrictive component (Category 2, under-review, investigational, or non-FDA-approved) governs the overall regulatory and safety posture of the blend, and that my clinician must complete a legal and clinical compliance review before initiating.
Known and unknown risks
I understand that potential risks include, without limitation: immune reactions or immunogenicity; infection from sterility or contamination problems; impurities or product variability; interactions with my current medications and supplements; lack of standardized dosing; effects on glucose, insulin, cortisol, or growth-hormone axis; cardiovascular effects (including a CHF safety signal noted for ibutamoren); unknown long-term effects; and changes in regulatory availability of any compound.
No guarantee of outcomes
I understand there is no guarantee of any specific outcome. Expected biological outcomes described in this tool are educational, not promises of result.
Disclosure duty
I have provided a complete and accurate medical, surgical, medication, supplement, allergy, pregnancy/lactation, and substance-use history. I will promptly disclose changes (including new diagnoses, new medications, pregnancy, or hospitalizations) before continuing any protocol.
Sourcing and verification
I understand that any prescribed compounded product should be sourced from a licensed compounding pharmacy and accompanied by Certificate of Analysis (COA) data verified by my clinician.
Monitoring and adverse events
I will follow the monitoring plan, attend follow-ups, and immediately report adverse effects to my clinician. For emergencies (severe allergic reaction, chest pain, severe shortness of breath, neurologic symptoms, or signs of infection), I will seek emergency care (call 911 in the United States or local emergency services).
Assumption of disclosed risks
Having reviewed and discussed the disclosures above with my clinician, I voluntarily choose to proceed and assume the disclosed risks to the extent permitted by applicable law. I understand this acknowledgment is not a release of any non-waivable rights, and that clinician and provider professional duties and applicable state law may limit the enforceability of any waiver. I have been advised that this form should be reviewed by licensed counsel for the practice and the state(s) in which it will be used.
Right to withdraw
I may decline or discontinue treatment at any time and request an alternative discussion with my clinician.
